[public trust doctrine]<br>
<b> </b><b>Oregon Supreme Court rules against youth plaintiffs in
climate change lawsuit</b><br>
The Oregon Supreme Court ruled against two young plaintiffs this
week in a lawsuit that alleged the state has failed to address the
mounting threats posed by climate change.<br>
<br>
Ollie Chernaik and Kelsey Juliana, both of Lane County, filed the
case in 2011 when they were minors. The lawsuit, which names Gov.
Kate Brown as the defendant, claims the state has failed to protect
vital resources from the impacts of climate change. Juliana is also
the lead plaintiff in a similar case against the federal government.<br>
- - <br>
The case hinges on the court's interpretation of an idea known as
the public trust doctrine, which dates back to the Byzantine Empire.
The doctrine was originally crafted to protect resources that are of
public benefit. In the Byzantine case, that meant the seashore up to
the high tide line, which was protected from private ownership. It
was later adopted as common law in the United States and reaffirmed
by a number of U.S. Supreme Court decisions dating back to the
1800s.<br>
<br>
Courtney Johnson, who represents Chernaik and Juliana, argued that
the state has a duty to protect resources that fall under the public
trust doctrine. Those resources include "the state's atmosphere as
well as the water, land, fishery and wildlife resources from the
impacts of climate change," according to the lawsuit...<br>
- -<br>
"How best to address climate change is a daunting question with
which the legislative and executive branches of our state government
must grapple," Walters wrote. "But that does not relieve our branch
of its obligation to determine what the law requires."<br>

<b>Donald Trump vs Joe Biden: Is 2020 a Climate Change Election?</b><br>
Oct 23, 2020<br>
Our Changing Climate<br>
With the final Donald Trump vs Joe Biden presidential debate wrapped
up and the 2020 election drawing near, this Our Changing Climate
environmental video essay video looks at what's at stake for climate
change when the choice is between Donald Trump and Joe Biden. Joe
Biden's climate change plan is a surprisingly progressive agenda.
Climate justice and climate mitigation are headliners of Joe Biden's
climate plan, and the Green New Deal is even mentioned in Biden's
climate plan. Compared to Joe Biden, Donald Trump has no climate
plan, and a Donald Trump presidency could spell climate change
disaster. The Trump White House has spent the last year dismantling
countless pieces of environmental and climate change legislation.
Unfortunately U.S. election system really only provides two choices:
Donald Trump vs Joe Biden. And in this 2020 election, where climate
change is a crucial issue, voting for Joe Biden is the better vote
for climate action. <br>

<b>The undeniable link between weather disasters and climate
change</b><br>
The events of this year are yet another sign of how incremental
increases in temperature can lead to exponentially worse natural
disasters, experts say. The global average temperature has
increased a little more than 1 degree Celsius (1.8 degrees
Fahrenheit) since the preindustrial era, a number that may seem
small. But research shows that human-caused warming has already
doubled the amount of western forest burned since 1984. This year
is California's worst fire season on record, with five of
California's six biggest recorded wildfires, including the state's
first million-acre "gigafire" since 1932.<br>
<br>
"It's really been a shocking escalation," said Daniel Swain, a
climate scientist at the University of California at Los Angeles.<br>
<br>
But that nonlinear relationship between rising temperatures and
escalating impacts does have a silver lining, Swain said. If
natural disasters become exponentially worse with every degree of
warming, the future will become exponentially safer with every
degree of warming humanity manages to avert.<br>
<br>
"It means there is no point in the future at which it becomes
pointless or hopeless to take action," Swain said. "From here
forward, everything we do is important."<br>

[opinion on US military and global warming]<br>
<b>The true cost of the military-industrial complex.</b><br>
Dec 6, 2019<br>
Our Changing Climate<br>
In this Our Changing Climate environmental video essay, I look at
the environmental and social cost of the military and militarism. I
narrow in on the United States military-industrial complex because
it is by far the biggest military machine in the world. I look at
how the military and the military-industrial complex is a massive
polluter in terms of both emissions and chemical waste. In addition,
the video looks at whether or not these environmental and monetary
burdens caused by the military-industrial complex are justified.
Have the multitude of wars the United States has wage been just, or
are they manifestations of imperialism. Ultimately, the video
connects environmental destruction with military imperialism and
concludes that demilitarization is the only truly effective answer
to the carbon footprint of the military.<br>
